These Terms constitute a legally binding agreement between you and Mintory regarding your use of the Service.
Mintory provides a non-custodial software interface for processing cryptocurrency payments. Our Service enables merchants to accept cryptocurrency payments directly to their wallets without intermediaries holding funds. We do not provide banking, money transmission, or other regulated financial services. The Service is provided on an "as is" and "as available" basis.
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You must be at least 18 years old to use the Service.
You are solely responsible for maintaining the confidentiality of your account credentials, including any wallet private keys, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.
We reserve the right to terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion, without prior notice or liability.
You agree not to use the Service for:
The Service and its original content, features, and functionality are and will remain the exclusive property of Mintory and its licensors. We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. Mintory operates as unregistered software with no business entity. We are not licensed, chartered, or regulated by any financial authority including FinCEN, SEC, CFTC, state money transmitter regulators, or international equivalents.
Mintory never holds, controls, accesses, or manages user funds. All cryptocurrency is transferred directly from payer to payee via the blockchain. Mintory provides only the software interface.
Cryptocurrency transactions are irreversible. Mintory cannot and will not reverse, cancel, or recover any payment. Users are solely responsible for verifying merchant legitimacy before payment.
BY USING MINTORY, YOU ACKNOWLEDGE AND ACCEPT THAT:
These Terms are governed by the laws of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, rather than in court. The arbitration shall take place in Delaware, and the arbitrator's decision shall be final and binding.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
